CDN Service Statement
This Service Agreement (hereinafter referred to as "this Agreement") describes your rights, obligations, and responsibilities of using Huawei Cloud services. Please read the terms carefully, especially the terms that have a significant impact on your rights and interests, such as exemption from liability and limitation of liability. Such terms are in bold in this Agreement
You understand and agree that by using any service as stated under this Agreement, you are deemed to have read and agree to the General Terms of Service in this Agreement and the Dedicated Terms of Service for the service you use. By using any service under this Agreement, this Agreement shall become legally binding on you. If you do not agree to part or all of the terms of this Agreement, you shall stop using any such related services.
1. General Terms of Service
1.1 Contracting Entity: This Agreement is entered into by and between Huawei Cloud Contracting Party as defined in Section 15.4 of Huawei Cloud Customer Agreement (hereinafter referred to as "Huawei Cloud", or "We") and you (or "User"). Once this Agreement takes effect, it has legal effect between you and Huawei Cloud. In the event that you register on behalf of a company or other legal entity, you represent and warrant that you are an authorized representative of the company or legal entity to bind such company or legal entity to the terms of this Agreement.
1.2 Separate Agreement: If you subscribe to this Service offline, purchase this Service through our partners, or purchase partner products that integrate this Service, you may sign a separate agreement with us or our partners. You acknowledge and agree that you will remain bound by the separate agreement mentioned in this article if you are authorized to access and use this Service.
1.3 Agreement Update: This Agreement is subject to change. We will notify you of any changes to this Agreement by posting a notice on our website or by other means. You can also visit our website to read the latest service agreement. If you do not agree to part or all of the latest version of this Agreement, please stop using this Service. By continuing to use this Service, you acknowledge that you are aware of and agree to the latest version of this Agreement.
1.4 Your Content
1.4.1 The definition and related regulations of "Your Content" are subject to the Huawei Cloud Customer Agreement (https://www.huaweicloud.com/eu/declaration/sa_cua.html ).
1.4.2 In terms of your content, except as required by laws and regulations or for your use of this Service, Huawei Cloud is entrusted to process your data only in accordance with your authorization and instructions and the agreement between you and us.
1.4.3 You have the right to upload, delete, and modify your content. Exercise caution when deleting or modifying data and you shall solelly bear the consequences of these operations.
1.4.4 You shall back up your data as required. Huawei Cloud provides data backup services only in accordance with relevant laws and regulations.
2. CDN Terms of Service
2.1 Service Content
Content Delivery Network (CDN) delivers content from origin servers to edge points of presence (PoPs), so users can obtain desired content from nearby PoPs. CDN prevents Internet congestion, speeds up website response, and ensures content availability.
2.2 Collection and processing of your personal data
You understand and agree that HUAWEI CLOUD has the right to collect, use, and process your personal data in accordance with the Privacy Policy Statement (https://www.huaweicloud.com/eu/declaration/sa_prp.html). Huawei Cloud promises to respect and protect your privacy in accordance with the Privacy Policy Statement.
2.3 Processing Your Content Data
You understand and agree that you are responsible for the legality of the source and acquisition of the personal data contained in Your Content in accordance with applicable personal data protection laws, Huawei Cloud is entrusted to process the personal data contained in Your Content. the description of processing is as follows:
● Personal data types and Purposes of the processing
When you and/or your end users use CDN in any form, CDN is entrusted by you to process your and/or your end users' personal data, including your tenant ID and access logs of your end users (personal information data such as anonymized IP addresses, request paths, response time, and User-Agent).
● Duration of the processing
We will comply with applicable laws and regulations and automatically delete the preceding personal data within six (6) months after you stop using CDN.
● Personal data Location of the processing
Your personal data will be stored in Ireland, Singapore, and China.
● Personal data cross-border transfer of the processing
To perform the contract or with your consent, we will transfer the personal data contained in Your Content across borders to Sparkoo Technologies Singapore Pte. Ltd in Singapore and Huawei Cloud Computing Technologies Co., Ltd. in China for billing and log download purposes. We will sign the Standard Contractual Clauses approved by the European Commission Implementing Decision (EU) 2021/914, to ensure that Sparkoo Technologies Singapore Pte. Ltd in Singapore and Huawei Cloud Computing Technologies Co., Ltd. in China process the personal data contained in Your Content in accordance with your instructions and take appropriate organizational and technical measures so that the personal data contained in Your Content is protected to the same level.
You understand and agree that the parties shall process the personal data contained in Your Content in accordance with the Data Processing Addendum (https://www.huaweicloud.com/eu/declaration/sa_dpa.html ). Huawei Cloud promises to process the personal data contained in Your Content in accordance with the Data Processing Addendum.
2.4 Cooperation You Need to Provide
2.4.1 The billing rules outlined in help documentation shall become effective for your account. For rule details, see https://support.huaweicloud.com/eu/price-cdn/cdn_01_0155.html
2.4.2 If your domain name is illegally occupied, provide proof of your domain name ownership. After we confirm your ownership, we will delete the occupied domain name within two (2) working days.
2.5 Restrictions
CDN does not support access to content data that violates relevant laws and regulations, including but not limited to behavior and content prohibited by the Acceptable Use Policy (https://www.huaweicloud.com/eu/declaration/sa_nisr.html)
In the event of the above-mentioned behavior, we have the right to suspend or terminate the provision of CDN Terms of Service and require you to compensate us for the actual losses caused thereby. In addition, we do not need to refund the cloud service fee and corresponding support service fee you have paid.
2.6 Disclaimer
2.6.1 You shall use CDN in strict accordance with this Agreement. If you use it beyond the scope of this Agreement or provide/transfer part or all of it to any third party in violation of this Agreement, you shall immediately make corrections, and compensate Huawei Cloud for all losses and expenses incurred therefrom. In addition, Huawei Cloud has the right to suspend the CDN service and terminate this Agreement.
2.6.2 You shall ensure that the content on your origin servers and the materials and data provided to Huawei Cloud comply with laws and regulations and do not infringe the legitimate rights and interests of third parties. You shall obtain the explicit consent or authorization of third parties before using third-party data. If you infringe on the rights and interests of a third party, thereby causing or potentially leading to claims or litigation against Huawei Cloud issued by such third party, you shall bear the responsibilities arising therefrom and compensate Huawei Cloud for all losses caused to Huawei Cloud. Huawei Cloud has the right to suspend the CDN service and terminate this Agreement.
2.6.3 If the raw data you provide contains any personal information of a third party, you shall ensure that the collection and provision of the above information comply with applicable laws and regulations such as the GDPR, including but not limited to explicitly stating the purpose, method, and scope of the collection and use of the information, and that you have obtained the explicit consent of the corresponding data subject.
2.6.4 If you use CDN PoPs in the Chinese mainland to provide website services (for example, your origin server is deployed on Huawei Cloud and your acceleration service area includes the Chinese mainland), complete Internet Content Provider (ICP) filing according to the Measures for the Archival Administration of Non-operational Internet Information Services. (For details, visit the Huawei Cloud ICP License Service at https://beian.huaweicloud.com/.) If you fail to complete filing, Huawei Cloud has the right to take measures, including but not limited to suspending services, against you in accordance with the HUAWEI CLOUD Customer Agreement and Acceptable Use Policy, and request you to compensate for all losses caused to Huawei Cloud.
2.6.5 After Huawei Cloud completes the CDN configuration for you, if you need to modify the configuration, notify Huawei Cloud fifteen (15) working days in advance and communicate with Huawei Cloud about technical communication, preparation, and testing. Huawei Cloud shall not be liable for any loss caused by service interruption due to your failure to notify Huawei Cloud in time or to cooperate with Huawei Cloud in technical communication, preparation, and testing.
2.6.6 If you anticipate a traffic surge, you must submit a request to Huawei Cloud at least three (3) working days in advance. For traffic surges expected during major holidays or promotions, you must submit a request at least one (1) month prior. If you fail to submit a request or if Huawei Cloud rejects your request, Huawei Cloud reserves the right to take measures such as rate limiting to ensure overall service stability. Huawei Cloud shall not be liable for any service unavailability resulting from the traffic surge. (Traffic surge definition: (1) A sudden increase in bandwidth usage. For customers on bandwidth- or traffic-based billing, a sudden increase is defined as any of the following: the bandwidth usage in the current calendar month increases by more than 500 Gbit/s compared to the previous month, the previous calendar month's peak bandwidth is 0 and the peak bandwidth in the current month exceeds 200 Gbit/s, or the peak bandwidth in the current calendar month increases by more than 30% compared to the previous month's billed bandwidth. If there is a separate written agreement, its terms shall prevail. (2) A sudden increase in QPS. For customers on bandwidth- or traffic-based billing, a sudden increase is defined as follows: the peak QPS in the current calendar month increases by more than 500,000 or more than 30% compared to the previous month. If there is a separate written agreement, its terms shall prevail.)
2.6.7 If your website page, application, or data is attacked, we reserve the right to restrict acceleration services for the affected domain name or suspend cloud services to you. We are not liable for any service unavailability resulting from such actions.
2.6.8 If your domain is targeted by attacks or malicious traffic, bandwidth usage or traffic may spike unexpectedly, leading to a bill higher than your normal expenditures. This high bill cannot be waived or refunded. You shall take measures to avoid such potential risks.
