CPH Service Statement
This service agreement (hereinafter referred to as "this Agreement") describes your rights, obligations, and responsibilities when you use related services. Please read and understand the terms thoroughly, especially the terms that have a significant impact on your rights and interests, such as exemption from liability and limitation of liability. Such terms are in bold in this Agreement.
You understand and agree that by using any services in this Agreement, you are deemed to have read and agreed to the General Terms of Service and the Dedicated Terms for the services you are using and that this Agreement shall become legally binding on you. If you do not agree to any or all of the terms in this Agreement, you shall stop using related services.
1. General Terms of Service
1.1 Contracting Entity
This Agreement is entered into by and between you (or "user") and Huawei Cloud Contracting Party ("Huawei Cloud" or "we"). The contracting entity displayed in your account center shall prevail. Once this Agreement takes effect, it has legal effect between you and Huawei Cloud. In the event that you register on behalf of a company or other legal entity or you use related services in any other manner permitted by Huawei Cloud, you represent and warrant that you are authorized to bind that company or legal entity to the terms of this Agreement.
1.2 Separate Agreement
If you subscribe to related services offline or purchase them through our partners, you may sign a separate agreement with us or our partners. You understand and agree that your access to and use of the related services will be governed by both this Agreement and that separate agreement.
1.3 Agreement Update
This Agreement is subject to change at any time. We may notify you of any changes to this Agreement by posting notice on our website or by other means. You can also visit our website to read the latest version of this Agreement. If you do not agree to any part of the latest version of this Agreement, you must stop using the related services. By continuing to use them, you understand and agree to the latest version of this Agreement.
1.4 Your Content
1.4.1 Unless otherwise stipulated in this Agreement, the definition of "Your Content" and related regulations shall be subject to the Huawei Cloud Customer Agreement (https://www.huaweicloud.com/intl/en-us/declaration-sg/sa_cua.html).
1.4.2 Unless otherwise required by applicable laws and regulations or otherwise agreed in a separate agreement, Huawei Cloud is entrusted to process Your Content only in accordance with your authorization and instructions.
1.4.3 You have the right to upload, delete, and modify Your Content. Exercise caution when performing these operations and you shall solely bear the consequences of such operations.
1.4.4 You are responsible for backing up Your Content. The specific backup scope, method, and frequency are determined by you based on your actual situation.
2. Dedicated Terms for CPH
2.1 Service Content
Cloud Phone Host (CPH) provides cloud phones virtualized from Huawei Cloud Kunpeng Bare Metal Servers (BMSs). These cloud phones are virtual phones running native Android.
2.2 Collection and Processing of Your Personal Data
2.2.1 Unless otherwise stipulated in this Agreement, you understand and agree that Huawei Cloud will collect, use, and process your personal data in accordance with the Privacy Statement (https://www.huaweicloud.com/intl/en-us/declaration-sg/sa_prp.html) during the entire service process. Huawei Cloud will respect and protect your privacy in accordance with this Privacy Statement.
2.3 Data Processing of Your Content
2.3.1 Processing Personal Data in Your Content
You understand and agree that all parties shall process personal data contained in Your Content in accordance with the Data Processing Addendum (https://www.huaweicloud.com/intl/en-us/declaration-sg/sa_dpa.html). Huawei Cloud promises to process your personal data in Your Content in accordance with this Data Processing Addendum.
2.4 Requirements and Restrictions
2.4.1 You shall not:
(1) Use this Service to engage in unfair competition prohibited by laws and regulations, including but not limited to: device flashing, bot farming, transaction fraud, click fraud, traffic hijacking, and other practices that hinder normal business operations.
(2) Use this Service to set up gambling platforms or unauthorized private servers, or use cross-border VPNs in violation of laws or regulations.
(3) Use this Service to launch network attacks on external systems, such as brute force attacks and spreading of viruses and Trojans, including but not limited to DDoS attacks, CC attacks, and web attacks.
(4) Use this Service to provide traffic penetration services.
(5) Use this Service to set up a crawling environment or initiate crawler requests to external systems.
(6) Use this Service to probe external systems, for instance, conducting scanning or penetration without being authorized by external system entities.
(7) Use this Service to deploy any illegal or non-compliant websites or applications.
(8) Use this Service to send spam or harassing emails or engage in any other activities that violate personal privacy.
(9) Use this Service to engage in acts that infringe upon trade secrets, cyber security, product security, and/or personal data and privacy of other operators or organizations.
(10) Use this Service to circumvent or violate any applicable laws and regulations, especially those related to intellectual property rights.
(11) Use this Service to engage in, incite, assist, or permit others to conduct any unlawful, infringing, harmful, or fraudulent activities, including but not limited to: harming or attempting to harm minors in any way; operating pornographic or illegal gambling; circumventing any applicable Internet regulatory requirements or other legal and regulatory obligations; participating in or assisting Ponzi schemes; carrying out cyberattacks or phishing; damaging or unlawfully intercepting any systems, programs, or data; monitoring service data or traffic without authorization; engaging in cryptocurrency mining or trading.
(12) Violate any applicable laws and regulations, Huawei Cloud Acceptable Use Policy, Legal Statement, Privacy Statement, Huawei Cloud Customer Agreement, and other agreements related to you on the Huawei Cloud official website when you are using this Service.
2.4.2 In the event of any above-mentioned behavior, we have the right to suspend or terminate the provision of related services and require you to compensate us for all losses thereby incurred (including direct and indirect losses, litigation costs, attorney's fees, travel expenses, and preservation insurance premiums). We will not refund the cloud service charges or corresponding support service charges you already paid.
2.4.3 If you use this Service to create groups or operate businesses in specific industries (including but not limited to education, healthcare, and finance), you must comply with any applicable laws and regulations on market access, user data protection, content management, and other. If you violate any of these applicable laws or regulations, you shall be solely liable for any losses or liabilities incurred and shall compensate us for all losses sustained by us (including direct and indirect losses, litigation costs, attorney's fees, travel expenses, and preservation insurance premiums).
2.4.4 If data leakage or other issues arise due to your use of unauthorized operating systems or software, or as a result of being infected with a Trojan, you understand and agree to voluntarily assume the consequences and ensure that Huawei Cloud will not suffer any loss thereby.
2.5 Risk Disclosure and Limitation of Liability
You understand and agree to the following:
(1) Huawei Cloud is committed to providing secure services but cannot guarantee absolute immunity from security threats or cyberattacks.
(2) Huawei Cloud cannot promise to be compatible with any other hardware, software, systems, services, or data that are not provided by this Service.
(3) This Service only provides compute infrastructure for the cloud mobile application ecosystem. It does not provide mobile application adaptation or risk control, and does not make any commitment or guarantee for the compatibility and risk control effectiveness of third-party mobile applications. This Service is not liable for abnormal application operations caused by non-compute infrastructure reasons, such as application version adaptation, third-party environments, configuration differences, and user operations.
(4) This Service provides open-source components (image system and device-cloud synergy solution) on Gitee. These functions may vary depending on user requirements or service versions. Huawei Cloud is not obligated to provide any form of support for open-source components on Gitee (including security services such as image integrity verification and virus scanning), and does not provide any express or implied warranty or guarantee for the compliance, security, and reliability of these components. Huawei Cloud shall not be liable for any loss or responsibility arising therefrom.
(5) Your custom images (for example, custom images created based on the open-source cloud-based AOSP system) are not image products provided by this Service. Huawei Cloud is not obligated to provide any form of support for your custom images (including security services such as image integrity verification and virus scanning), and does not provide any express or implied warranty or guarantee for the compliance, security, and reliability of these images. Huawei Cloud shall not be liable for any loss or responsibility arising therefrom.
(6) To provide you with better services, Huawei Cloud has the right to perform regular or irregular maintenance, such as repair, upgrade, and optimization, on service platforms or related devices, systems, and software. This may cause short-term interruptions or suspension of your services. Huawei Cloud will provide you with prior notice within a reasonable period of time. Huawei Cloud shall be exempted from liability for service interruptions, data loss, or other issues arising therefrom.
(7) To ensure service security and stability, Huawei Cloud may need to make major adjustments, such as data center decommissioning, reconstruction, and migration, as well as device replacement. These adjustments may affect your services. Huawei Cloud will notify you at least 30 days in advance so that you can migrate or adjust your service system if necessary. You shall actively cooperate in the migration of related data and promise to complete the operations within the time specified by Huawei Cloud after receiving notice from Huawei Cloud. Huawei Cloud shall be exempted from liability for service access failures, data loss, or other issues caused by the major adjustments, such as data center decommissioning, reconstruction, and migration, or device replacement.
