Live Service Agreement
This Service Agreement (hereinafter referred to as "this Agreement") describes your rights, obligations, and responsibilities of using Huawei Cloud services. Please read the terms carefully, especially the terms that have a significant impact on your rights and interests, such as exemption from liability and limitation of liability. Such terms are in bold in this Agreement.
You understand and agree that by using any service as stated under this Agreement, you are deemed to have read and agree to the General Terms of Service in this Agreement and the Dedicated Terms of Service for the service you use. By using any service under this Agreement, this Agreement shall become legally binding on you. If you do not agree to part or all of the terms of this Agreement, you shall stop using any such related services.
1. General Terms of Service
1.1 Contracting Entity: This Agreement is entered into by and between Huawei Cloud Contracting Party as defined in Section 15.4 of Huawei Cloud Customer Agreement (hereinafter referred to as "Huawei Cloud", or "We") and you (or "User"). Once this Agreement takes effect, it has legal effect between you and Huawei Cloud. In the event that you register on behalf of a company or other legal entity, you represent and warrant that you are an authorized representative of the company or legal entity to bind such company or legal entity to the terms of this Agreement..
1.2 Separate Agreement: If you subscribe to this Service offline, purchase this Service through our partners, or purchase partner products that integrate this Service, you may sign a separate agreement with us or our partners. You acknowledge and agree that you will remain bound by the separate agreement mentioned in this article if you are authorized to access and use this Service.
1.3 Agreement Update: This Agreement is subject to change. We will notify you of any changes to this Agreement by posting a notice on our website or by other means. You can also visit our website to read the latest service agreement. If you do not agree to part or all of the latest version of this Agreement, please stop using this Service. By continuing to use this Service, you acknowledge that you are aware of and agree to the latest version of this Agreement.
1.4 Your Content
1.4.1 The definition and related regulations of "Your Content" are subject to the Huawei Cloud Customer Agreement (https://www.huaweicloud.com/intl/en-us/declaration-sg/sa_cua.html ).
1.4.2 In terms of your content, except as required by laws and regulations or for your use of this Service, Huawei Cloud is entrusted to process your data only in accordance with your authorization and instructions and the agreement between you and us.
1.4.3 You have the right to upload, delete, and modify your content. Exercise caution when deleting or modifying data and you shall solelly bear the consequences of these operations.
1.4.4 You shall back up your data as required. Huawei Cloud provides data backup services only in accordance with relevant laws and regulations.
2. Live Terms of Service
2.1 Service Content
Huawei Cloud Live is the cumulation of years of video expertise. It offers a secure and high-concurrency E2E livestreaming solution while delivering a low-latency HD experience.
Live offers the following subproducts:
(1) Cloud Live: This easy-to-use service provides diverse livestream acceleration capabilities for entertainment, e-commerce, and education scenarios.
(2) Media Live: This broadcast-grade livestreaming service supports features such as channel management and content encryption, making it an ideal option for media organizations and broadcasting.
2.2 Collection and Processing of Your Personal Data
You understand and agree that, for the purpose of providing this Service, Huawei Cloud has the right to collect, use, and process your personal data in accordance with the Privacy Statement (https://www.huaweicloud.com/intl/en-us/declaration-sg/sa_prp.html). Huawei Cloud promises to respect and protect your privacy in accordance with the Privacy Statement.
2.3 Processing Your Content Data
2.3.1 Processing Personal Data Contained in Your Content
You understand and agree that you shall, in accordance with applicable personal data protection laws, be responsible for the legality of the collection, use, and transmission of personal data contained in Your Content, including audio/video streams, videos, images, IP addresses, device models, network connection information, basic system information, browser information, and session IDs. Huawei Cloud is entrusted to process the personal data contained in Your Content as follows:
- Data types and purposes
Purpose 1: When your end users push or play livestreams, we will process the audio/video streams uploaded by your end users. If you have configured recording and snapshot capturing, we will process the audio/video streams to generate videos and images so you can push livestreams, play and record live videos, and capture snapshots.
Purpose 2: When you query key livestreaming metrics (including the bandwidth/traffic usage, transcoding/recording/snapshot usage, status codes, viewer count, and pushed stream count), download workload logs, or request the assistance of O&M personnel to analyze and locate issues, we will process your end users' data, including IP addresses, device models, network connection information, basic system information, browser information, and session IDs. This data is processed to provide you with log downloads, usage statistics, service monitoring, and issue analysis and troubleshooting capabilities.
Purpose 3: If ads are configured for your channels, we will, upon your request, process your end users' IP addresses, basic system information, browser information, and your configured settings to deliver ads to the end users.
- Retention
Purpose 1: Audio/Video streams are cached only in the memory of Live servers and will be automatically cleared after the livestreaming ends. Videos and images are stored in your OBS buckets. You can delete the videos and images from your OBS buckets.
Purpose 2: The retention period of IP addresses, device models, network connection information, basic system information, browser information, and session IDs is 90 days.
Purpose 3: The retention period of IP addresses, basic system information, and browser information is 30 days.
- Location
The location of the processing is the selected region of this Service.
- Sub-trustees
When your end users and the audio/video streaming sources are located in different countries, as necessary for the performance of the contract, we are commissioned by you to entrust the personal information contained in Your Content to Huawei Cloud affiliated entities for processing, solely for streaming and playback purposes. We ensure that the personal information contained in Your Content is processed in accordance with the aforementioned purposes, and that appropriate technical and organizational measures are implemented to protect the personal information contained in Your Content.
- Cross-border transfer
We will not transfer the personal data contained in Your Content out of the selected region of this Service.
To provide you with the international livestreaming function, you need to configure an acceleration area for the domain name. If you set Service Area to Global, and your end users are watching live videos using the domain name, the audio/video data of the domain name will be transferred across borders from the region where the service you select is to the country or region where your end users are. You understand and agree that you have full control and ownership of the preceding data transferred across borders. You shall comply with applicable laws and regulations to ensure the legality of cross-border data transfer. This Service only provides technical capabilities for data forwarding and is entrusted to transfer your content data. You shall be responsible for your cross-border data transfer.
2.4 Pricing
We will release information regarding billing modes, pricing systems, and other details on the Huawei Cloud official website. For specific billing rules, see the billing description at https://support.huaweicloud.com/intl/en-us/live/index.html.
You shall keep your account balance sufficient to ensure continuous use of this Service. We reserve the right to withhold or terminate services before you pay the fees as agreed. In addition, we reserve the right to pursue legal liabilities for any outstanding fees.
You understand and agree that we have the right to adjust the product portfolio, names, pricing, and billing modes of Live from time to time based on our business operations. We will notify you of the adjustments and changes in advance through official website announcements, internal notifications, or other means, or through the contact information you have provided.
2.5 Requirements and Restrictions
You understand and agree that your use of this Service must comply with applicable laws and regulations. We only provide you with standard services upon your request, and Huawei Cloud assumes no liability for the legality and compliance of your use of this Service or Your Content. You shall be liable for any improper operations, non-compliant data sources, or illegal behaviors during your use of this Service. You shall be liable for any damage caused to Huawei Cloud due to the aforementioned behaviors.
2.6 Security Configuration
The URLs involved in this Service are provided by you, and you are strongly advised to enable URL access authentication. If you do not enable it, your domain name will have unrestricted access, which may expose your livestreaming resources to risks of hotlinking or abuse. You shall bear any service fees incurred as a result, and Huawei Cloud shall not be liable for any such fees and will not refund any fees for services used.
2.7 Disclaimer
2.7.1 You understand and agree that we are not liable for unavailability of this Service in the following situations:
(1) Service unavailability or any legal consequences caused by your refusal to provide relevant information or the provided information failing to meet service requirements
(2) Service unavailability due to force majeure
(3) Service unavailability due to your reasons or non-Huawei Cloud reasons
(4) Service unavailability during scheduled service maintenance
2.7.2 You understand and agree that before this Service reaches the end of service (EOS) phase in its lifecycle, we will notify you in advance through official website announcements, internal notifications, or other means, or through the contact information you have provided. You need to migrate or upgrade related workloads within a certain time window based on the Huawei Cloud notification. If you fail to cooperate, you agree that Huawei Cloud reserves the right to automatically upgrade this Service to a new version when the right opportunity arises. We shall not be held liable for any potential service outage or unavailability resulting therefrom.
2.7.3 If you anticipate a traffic surge for your livestreaming services, apply for temporary burst capacity from Huawei Cloud at least three (3) working days in advance. For traffic surges tied to major holidays or major events (including but not limited to the Spring Festival Gala and Double Eleven shopping festival), submit your request at least one (1) month prior. If your request is rejected or no request is submitted, Huawei Cloud reserves the right to take measures such as rate limiting to ensure the service stability for all users. Huawei Cloud shall not be liable for any availability issues caused thereby.
Traffic surge definition:
(1) For customers on bandwidth-based billing, a sudden increase is defined as any of the following: the bandwidth in the current calendar month increases by more than 500 Gbit/s compared to the previous month, the previous calendar month's peak bandwidth is 0 and the peak bandwidth in the current month exceeds 200 Gbit/s, or the bandwidth in the current calendar month increases by more than 30% compared to the previous month's billed bandwidth. If there is a separate written agreement, its terms shall prevail.
(2) For customers on traffic-based billing, a sudden increase is defined as: the peak bandwidth in the current calendar month exceeds 10 Gbit/s. If there is a separate written agreement, its terms shall prevail.
2.7.4 If your website pages, applications, or data are subjected to hacker attacks, we reserve the right to restrict the acceleration services for the corresponding domain name or stop providing cloud services to you. We shall not be liable for any service unavailability caused thereby.
2.7.5 In the event of attacks or malicious traffic targeting your domain name, sudden bandwidth or traffic spikes may occur, leading to a bill higher than your normal expenditures. This high bill cannot be waived or refunded. You shall take measures to avoid such scenarios.
2.7.6 If you or your end users use this Service to conduct business operations in specific industries (such as education, healthcare, and banking), you or your end users must comply with the laws and regulations of the specific industries. You shall be solely liable for any consequences arising from your failure to comply with relevant laws and regulations. You shall be liable for any damage caused to Huawei Cloud due to the aforementioned behaviors.
