Workspace Service Agreement
This Service Agreement ("this Agreement") describes your rights, obligations, and responsibilities of using Huawei Cloud services. Please read the terms carefully, especially those that have a significant impact on your rights and interests, such as exemption from liability and limitation of liability. Such terms are in bold in this Agreement.
You understand and agree that by using any service as stated under this Agreement, you are deemed to have read and agreed to the General Terms of Service in this Agreement and the Dedicated Terms of Service for the service you use. By using any service under this Agreement, this Agreement shall become legally binding on you. If you do not agree to part or all of the terms of this Agreement, you shall stop using any such related services.
1. General Terms of Service
1.1 Contracting Entity. This Agreement is entered into by and between Huawei Cloud Contracting Party ("Huawei Cloud" or "We") as defined in Section 15.4 of the Huawei Cloud Customer Agreement and you ("User"). Once this Agreement takes effect, it has legal effect between you and Huawei Cloud. The contracting entity displayed in your account center shall prevail. In the event that you register on behalf of a company or other legal entity, you represent and warrant that you are an authorized representative of the company or legal entity to bind such company or legal entity to the terms of this Agreement.
1.2 Separate Agreement. If you subscribe to this Service offline, purchase this Service through our partners, or purchase partner products that integrate this Service, you may sign a separate agreement with us or our partners. You acknowledge and agree that you will remain bound by the separate agreement mentioned in this article if you are authorized to access and use this Service.
1.3 Agreement Update. This Agreement is subject to change at any time. We will notify you of any changes to this Agreement by posting a notice on our website or by other means. You can also visit our website to read the latest service agreement. If you do not agree to part or all of the latest version of this Agreement, please stop using this Service. By continuing to use this Service, you acknowledge that you are aware of and agree to the latest version of this Agreement.
1.4 Your Content
1.4.1 The definitions and related regulations of "Your Content" are subject to the Huawei Cloud Customer Agreement:

1.4.2 In terms of Your Content, except as required by laws and regulations or for your use of this Service, Huawei Cloud is entrusted to process your data only in accordance with your authorization and instructions and the agreement between you and us.
1.4.3 You have the right to upload, delete, and modify Your Content. Exercise caution when deleting or modifying data and you shall solely bear the consequences of these operations.
1.4.4 You shall back up your data as required. Huawei Cloud provides data backup services only in accordance with relevant laws and regulations.
2. Huawei Cloud Workspace Terms of Service
2.1 Service Content
Huawei Cloud Workspace provides Workspace desktops and Application Streaming. Workspace desktops can be quickly created, deployed, and managed. Users can apply for and use Workspace desktops on demand without deploying a large amount of hardware. Application Streaming is an application streaming transmission service hosted on Huawei Cloud. You can run desktop applications on cloud servers and securely transmit the applications to devices through streams. End users can access the applications from multiple devices anywhere, implementing on-demand, secure, and low-cost access.
2.2 Collection and Processing of Your Personal Data
For the entire service process, you understand and agree that Huawei Cloud is entitled to collect, use, and process your personal data in accordance with the Privacy Statement (https://www.huaweicloud.com/intl/en-us/declaration-sg/sa_prp.html).
2.3 Data Processing of Your Content
You understand and agree that you shall, in accordance with applicable personal data protection laws, be responsible for the legality of the collection, use, and transmission of personal data in Your Content. Such personal data includes the account information, desktop service information, and device information of your end users, and information about the cloud applications that your end users are authorized to use. Huawei Cloud is entrusted to process the personal data in Your Content as follows:
● Data types and purposes
a) When you manage users in Workspace, we will process the user account information (including the username, password, email address, and mobile number) you enter to provide the end-user management service for you.
b) When your end users log in to Workspace from a client, we will process your enterprise ID (enterprise name), and the account information (including verification codes and user IDs) and login device information (such as IP addresses, MAC addresses, UUIDs or Android IDs, and OS types) of your end users to provide the end-user identity authentication service for you.
c) When your end users use Workspace, we will process information of your end users, including the accounts, desktop hosts (such as the host names and IDs, desktop OS types, desktop system statuses, desktop screen recording files, start time and duration of desktop screen recording, desktop collaboration verification codes, and desktop collaboration passwords), basic application information (such as the application names and versions), user connection records (such as connection statistics and connection details), desktop usage records, user operation records, application records (such as user access failure statistics, application usage records, and user login records), login devices (including the device SIDs and device statuses), application logs, usage duration (such as the start time and end time), and text, images, and videos provided or uploaded by you or your end users. This allows us to provide Workspace desktops or Application Streaming for your end users, and to provide the management service of Workspace desktops or cloud applications for you. If a cloud desktop or cloud application of your enterprise or organization is faulty, we will help you maintain the server on which this cloud desktop or cloud application runs after obtaining your authorization (for example, via email).
● Period
By default, application log information will be retained for six months. Other information will be deleted immediately upon unsubscription.
● Location
The location of the processing is the selected Huawei Cloud region of this Service.
● Sub-trustees
We will not entrust any third parties to process the personal data contained in Your Content.
● Cross-border transfer
We will not transfer the personal data contained in Your Content out of the selected Huawei Cloud region of this Service.
You understand and agree that both parties shall process the personal data contained in Your Content in accordance with the Data Processing Addendum (https://www.huaweicloud.com/intl/en-us/declaration-sg/sa_dpa.html).
2.4 Cooperation You Need to Provide
When you create a desktop or application streaming instance on Huawei Cloud Workspace, you can use customized private images. Huawei Cloud does not provide any support for the OSs or other software you install. No express or implied warranty is made, and Huawei is not liable for any loss or liability caused by the OSs or other software you install. End users are responsible for OS security hardening and vulnerability patch upgrade, and need to download the patches from the official website. If data leakage or other legal issues occur due to Trojan horses, backdoors, or the non-official OSs or software that you or your end users use, you understand and agree to voluntarily bear the consequences and ensure that Huawei Cloud will not suffer any losses.
2.5 Restrictions
When using Huawei Cloud Workspace, you shall be responsible for the source and content of your end users' service data, and shall not:
(1) violate related laws and regulations of the country/region where your business is operated, or use Huawei Cloud Workspace or Application Streaming to perform technical behaviors that endanger network security, such as computer viruses, network attacks, and network intrusions.
(2) use Huawei Cloud Workspace or Application Streaming to publish any content that violates laws, regulations, or national policies.
In the event of any of the preceding behaviors, we have the right to unilaterally suspend or terminate this Service and ask you to compensate us for any and all losses arising therefrom. In addition, we have the right to withhold any cloud service fees or support service fees you have already paid.
